Messieurs les Pr\u00e9fets maritimes<\/strong><\/p>\n\n\n\n

Nous reconnaissons la r\u00e9ception de l\u2019arr\u00eat\u00e9 inter-pr\u00e9fectoral et souhaitons, par la pr\u00e9sente, apporter bri\u00e8vement des \u00e9l\u00e9ments de clarification quant \u00e0 notre situation et \u00e0 notre position.<\/p>\n\n\n\n

\u00c0 cet \u00e9gard, nous souhaitons tout d\u2019abord attirer votre attention \u00e0 l\u2019histoire du navire : comme vous le savez, le TS Shtandart a quitt\u00e9 son port d\u2019attache d\u2019origine, Saint-P\u00e9tersbourg, en 2009 pour des raisons politiques et n\u2019est pas retourn\u00e9 dans les eaux russes depuis lors.<\/p>\n\n\n\n

Depuis cette date, le navire a particip\u00e9 \u00e0 de nombreux festivals maritimes et \u00e9v\u00e9nements portuaires en Europe occidentale, dont un grand nombre en France, sans jamais susciter d\u2019attention n\u00e9gative de la part des autorit\u00e9s et n'est pas associ\u00e9 \u00e0 quelconque soutien au gouvernement russe.<\/p>\n\n\n\n

Au contraire, le TS Shtandart et son \u00e9quipage ont nou\u00e9 des relations durables et de confiance avec les ports fran\u00e7ais, les organisateurs de festivals et la communaut\u00e9 des grands voiliers. Compos\u00e9 d\u2019un \u00e9quipage international r\u00e9unissant souvent des individus de plus de dix pays, le navire contribue \u00e0 la formation maritime, aux \u00e9changes culturels et \u00e0 la pr\u00e9servation du patrimoine maritime commun europ\u00e9en.<\/p>\n\n\n\n

Lorsque la Russie a attaqu\u00e9 l\u2019Ukraine en 2022, cet \u00e9v\u00e9nement a profond\u00e9ment affect\u00e9 l\u2019\u00e9quipage. Le capitaine et l\u2019ensemble de l\u2019\u00e9quipage rejettent sans r\u00e9serve cette guerre d\u2019agression, comme en t\u00e9moignent des d\u00e9clarations publiques. Il est important de pr\u00e9ciser clairement que ni le capitaine, ni l\u2019\u00e9quipage, ni le projet n\u2019ont jamais soutenu la guerre d\u2019agression men\u00e9e par la Russie contre l\u2019Ukraine. Cette position est claire et align\u00e9e avec le rejet fondamental par le projet, de toute forme de haine et de violence, et contraste nettement avec sa vocation premi\u00e8re, qui est de favoriser les \u00e9changes internationaux et l\u2019amiti\u00e9 en mer.<\/p>\n\n\n\n

Dans le m\u00eame temps, il est important de comprendre que le capitaine ainsi que certains membres de l\u2019\u00e9quipage ont des familles en Russie. Des prises de position politiques publiques, en particulier en l\u2019absence d\u2019un port d\u2019attache s\u00e9curis\u00e9 en Europe occidentale, comportent d\u00e8s lors des risques personnels, non seulement pour eux-m\u00eames mais \u00e9galement pour des tiers, tels que le chantier naval de Saint-P\u00e9tersbourg o\u00f9 le navire a \u00e9t\u00e9 initialement construit. \u00c0 la lumi\u00e8re de cas tels que celui d\u2019Alexe\u00ef Navalny, ces pr\u00e9occupations ne sont pas th\u00e9oriques et ces pr\u00e9cautions demeurent n\u00e9cessaires.<\/p>\n\n\n\n

Par ailleurs, et en particulier depuis 2022, des mesures importantes ont \u00e9t\u00e9 prises afin de distancier le projet de la Russie et d\u2019assurer son int\u00e9gration dans l\u2019espace europ\u00e9en :<\/p>\n\n\n\n

* Changement de pavillon :<\/strong> Russie \u2192 \u00celes Cook (06.06.2024)<\/p>\n\n\n\n

* Changement de propri\u00e9taire : <\/strong>transfert \u00e0 Mariia Martus (de nationalit\u00e9s finlandaise et russe, r\u00e9sidant \u00e0 Helsinki depuis plus de dix ans)<\/p>\n\n\n\n

* R\u00e9sidence du capitaine : <\/strong>Allemagne (depuis 2011)<\/p>\n\n\n\n

* Exploitant :<\/strong> MartusTV, Allemagne (depuis 2016), soumis \u00e0 la fiscalit\u00e9 de l\u2019Union europ\u00e9enne<\/p>\n\n\n\n

* Organisation des volontaires : <\/strong>France<\/p>\n\n\n\n

En outre, le navire :<\/p>\n\n\n\n

* ne transporte pas de marchandises sous sanctions telles que le p\u00e9trole ou d\u2019autres produits strat\u00e9giques ;<\/p>\n\n\n\n

* ne g\u00e9n\u00e8re aucun revenu au profit de l\u2019\u00c9tat russe ou d\u2019entit\u00e9s contr\u00f4l\u00e9es par celui-ci ;<\/p>\n\n\n\n

* a apport\u00e9 son soutien et accueilli des r\u00e9fugi\u00e9s ukrainiens.<\/p>\n\n\n\n

Dans ce cadre, nous nous sommes conform\u00e9s sans d\u00e9lai \u00e0 la recommandation des autorit\u00e9s fran\u00e7aises visant \u00e0 remplacer le pavillon russe par celui des \u00celes Cook, que nous arborons depuis lors. Le r\u00e8glement de l\u2019Union europ\u00e9enne de 2024 mentionnant explicitement les \u00ab r\u00e9pliques de navires historiques \u00bb nous a \u00e9galement profond\u00e9ment affect\u00e9s, dans la mesure o\u00f9 il vise manifestement le Shtandart, en l\u2019assimilant \u00e0 la flotte fant\u00f4me russe. Il en r\u00e9sulte une assimilation particuli\u00e8rement disproportionn\u00e9e, mettant sur un m\u00eame plan un p\u00e9trolier de 300 m\u00e8tres transportant du p\u00e9trole sous sanction et un petit voilier-\u00e9cole sans aucun lien financier avec la Russie et qui s\u2019oppose ouvertement \u00e0 la guerre.<\/p>\n\n\n\n

Cette situation a plac\u00e9 le projet dans une position particuli\u00e8rement difficile. Au lieu de poursuivre sa participation aux \u00e9v\u00e9nements maritimes europ\u00e9ens, le navire a d\u00fb recourir \u00e0 des activit\u00e9s alternatives afin d\u2019assurer sa p\u00e9rennit\u00e9. C\u2019est dans ce contexte qu\u2019une demande de l\u2019agence de voyage russe \u00ab Kombat Tours \u00bb a \u00e9t\u00e9 accept\u00e9e, dans l\u2019espoir qu\u2019une solution politique puisse \u00eatre trouv\u00e9e d\u2019ici juin 2026 permettant de revenir dans les ports fran\u00e7ais. Il convient de pr\u00e9ciser que le voyage en question a \u00e9t\u00e9 annul\u00e9 d\u00e8s d\u00e9cembre 2025.<\/p>\n\n\n\n

Nous sommes inform\u00e9s que des \u00e9l\u00e9ments concernant le Shtandart ont \u00e9t\u00e9 communiqu\u00e9s aux autorit\u00e9s par des acteurs ext\u00e9rieurs, notamment M. Bernard Grua. \u00c0 cet \u00e9gard, nous souhaitons respectueusement souligner que certaines all\u00e9gations graves ont \u00e9t\u00e9 publiquement formul\u00e9es, \u00e9tablissant un lien entre le navire et un soutien au gouvernement russe. Ces all\u00e9gations sont infond\u00e9es et ne refl\u00e8tent ni la r\u00e9alit\u00e9 du projet, ni ses activit\u00e9s, ni sa position.<\/p>\n\n\n\n

Nous vous serions reconnaissants de bien vouloir \u00e9valuer ces affirmations avec la plus grande prudence et, dans la mesure du possible, de les confronter aux faits \u00e9tablis ainsi qu\u2019aux d\u00e9clarations publiques du navire.<\/p>\n\n\n\n

Malgr\u00e9 des attaques personnelles et des propos diffamatoires sur l'internet, le Shtandart continue de b\u00e9n\u00e9ficier d\u2019un soutien fort et constant au sein de la communaut\u00e9 europ\u00e9enne des grands voiliers. Les partenaires fran\u00e7ais, organisateurs et capitaines demeurent en contact \u00e9troit avec nous et expriment leur souhait de voir le navire revenir dans les eaux europ\u00e9ennes.<\/p>\n\n\n\n

Nous tenons \u00e9galement \u00e0 souligner que le TS Shtandart ne peut ni ne souhaite retourner en Russie. Son objectif est clairement de poursuivre ses activit\u00e9s dans l\u2019espace maritime europ\u00e9en, o\u00f9 il est actif depuis plus de quinze ans et o\u00f9 se trouvent son r\u00e9seau et sa communaut\u00e9. Notre intention est de reprendre et de maintenir ce r\u00f4le au sein de la communaut\u00e9 maritime europ\u00e9enne, ainsi que de revenir en France, et notamment \u00e0 La Rochelle, notre port d\u2019attache d\u2019adoption.<\/p>\n\n\n\n

La pr\u00e9sente lettre n\u2019a pas pour objet de contester votre d\u00e9cision. Nous sommes conscients que cette situation d\u00e9pend en dernier ressort de l\u2019interpr\u00e9tation et de l\u2019application de la loi de l\u2019Union europ\u00e9enne, actuellement soumises \u00e0 un examen juridictionnel. Nous vous demandons toutefois respectueusement de bien vouloir prendre en consid\u00e9ration notre situation dans l\u2019ensemble de son contexte factuel.<\/p>\n\n\n\n
