Construit \u00e0 Saint-P\u00e9tersbourg en 1999 avec le soutien d\u2019ambassades europ\u00e9ennes et sous le patronage des monarchies britannique et n\u00e9erlandaise, le navire a quitt\u00e9 les eaux russes en 2009 pour des raisons politiques \u00e9videntes. Depuis lors, son capitaine, Vladimir Martus, r\u00e9sident permanent de l\u2019UE depuis 2011, g\u00e8re enti\u00e8rement le navire depuis l\u2019Europe, sans aucun lien avec l\u2019\u00c9tat russe.<\/p>\n\n\n\n<p class=\" translation-block\">Pourtant aujourd\u2019hui, le Shtandart fait face \u00e0 des interdictions injustifi\u00e9es d\u2019entrer dans les ports europ\u00e9ens. Cette situation r\u00e9sulte d\u2019une combinaison de mauvaise interpr\u00e9tation du droit europ\u00e9en en mati\u00e8re de sanctions et de la campagne agressive d\u2019un groupe d\u2019activistes, \u00ab No Shtandart in Europe \u00bb, dirig\u00e9 par M. Bernard Grua.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Une campagne de harc\u00e8lement et de d\u00e9sinformation<\/h2>\n\n\n\n<p>Depuis trois ans, M. Grua m\u00e8ne une campagne personnelle contre le navire et son \u00e9quipage, publiant des contenus diffamatoires, envoyant des lettres hostiles aux autorit\u00e9s, et prof\u00e9rant m\u00eame des menaces signal\u00e9es \u00e0 la police et au procureur en France.<\/p>\n\n\n\n<p class=\" translation-block\">Le 24 juin 2024, son groupe a publiquement c\u00e9l\u00e9br\u00e9 l\u2019inclusion des \u00ab r\u00e9pliques de navires historiques \u00bb dans la D\u00e9cision PESC 2024\/1744 de l\u2019UE, la qualifiant de \u00ab victoire \u00bb. Depuis, il tente de faire appliquer cette sanction de mani\u00e8re priv\u00e9e, en surveillant les d\u00e9placements du navire et en contactant les autorit\u00e9s locales \u00e0 chaque escale pr\u00e9vue du Shtandart.<\/p>\n\n\n\n<p class=\" translation-block\">Ce harc\u00e8lement ne vise pas seulement le navire, mais s\u2019\u00e9tend \u00e9galement aux organisations et aux individus qui le soutiennent. Festivals maritimes, associations et m\u00eame simples citoyens ont subi pressions et intimidations en ligne pour avoir accueilli le Shtandart.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">L\u2019abus du droit europ\u00e9en en mati\u00e8re de sanctions<\/h2>\n\n\n\n<p>Le contexte r\u00e9glementaire est essentiel pour comprendre l\u2019interdiction actuelle.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\" translation-block\">Avant le 24 juin 2024, tant les autorit\u00e9s espagnoles que fran\u00e7aises avaient confirm\u00e9 que le Shtandart n\u2019\u00e9tait pas concern\u00e9 par les sanctions (voir le Pr\u00e9fet du Finist\u00e8re devant le Tribunal administratif de Rennes, 9 octobre 2024).<\/li>\n\n\n\n<li class=\" translation-block\">L\u2019ajout des r\u00e9pliques le 24 juin 2024 ne peut concerner que des navires battant pavillon russe et participant \u00e0 l\u2019effort de guerre russe. Le Shtandart ne r\u00e9pond \u00e0 aucun de ces crit\u00e8res : il est d\u00e9tenu par des Europ\u00e9ens, g\u00e9r\u00e9 par un r\u00e9sident de l\u2019UE, et reimmatricul\u00e9 sous pavillon des \u00celes Cook.<\/li>\n\n\n\n<li class=\" translation-block\">Le refus de la Cour de justice de l\u2019UE d\u2019annuler le r\u00e8glement ne cl\u00f4t pas le d\u00e9bat. Il laisse ouverte la voie d\u2019un recours en interpr\u00e9tation, afin de pr\u00e9ciser que des r\u00e9pliques comme le Shtandart ne sont pas vis\u00e9es.<\/li>\n\n\n\n<li>Le droit europ\u00e9en et les trait\u00e9s internationaux reconnaissent d\u00e9j\u00e0 le statut particulier des navires historiques :\n<ul class=\"wp-block-list\">\n<li class=\" translation-block\">La Directive 2009\/45\/CE exempte les r\u00e9pliques de navires historiques \u00e0 passagers des r\u00e9glementations modernes.<\/li>\n\n\n\n<li class=\" translation-block\">L.a Convention de La Haye (1954) prot\u00e8ge les biens culturels, interdisant explicitement les repr\u00e9sailles contre ce patrimoine en temps de conflit.<\/li>\n\n\n\n<li>La loi fran\u00e7aise (n\u00b0 94-679 de 1994) permet l\u2019octroi du statut de bien culturel \u00e0 des navires \u00e9trangers lors de grands rassemblements, statut d\u00e9j\u00e0 accord\u00e9 \u00e0 d\u2019autres grands voiliers construits en Russie<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li class=\" translation-block\">La liste annex\u00e9e des navires sanctionn\u00e9s (Annexe LXVII) n\u2019inclut pas le Shtandart, m\u00eame apr\u00e8s le 19\u1d49 paquet de sanctions, soulignant encore que son interdiction rel\u00e8ve d\u2019un exc\u00e8s d\u2019interpr\u00e9tation et non du droit.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Pourquoi la d\u00e9cision de la Cour europ\u00e9enne n\u2019est pas d\u00e9finitive<\/h2>\n\n\n\n<p class=\" translation-block\">La Cour de justice a r\u00e9cemment refus\u00e9 de se saisir du dossier, mais ce n\u2019est pas la fin de la voie judiciaire. L\u2019enjeu r\u00e9side d\u00e9sormais dans une demande d\u2019interpr\u00e9tation, et non d\u2019annulation. Cette strat\u00e9gie permet de clarifier que le Shtandart \u2014 r\u00e9plique culturelle g\u00e9r\u00e9e en Europe \u2014 ne rel\u00e8ve pas des sanctions, sans remettre en cause la l\u00e9gislation de l\u2019UE.<\/p>\n\n\n\n<p>Une telle interpr\u00e9tation r\u00e9tablirait la s\u00e9curit\u00e9 juridique pour les autorit\u00e9s maritimes europ\u00e9ennes et \u00e9viterait de futures erreurs d\u2019application du droit.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Un navire de patrimoine, de paix et d\u2019\u00e9ducation<\/h2>\n\n\n\n<p>Loin d\u2019\u00eatre un instrument politique, le Shtandart est une \u00e9cole flottante et un pont culturel :&nbsp;<em>Shtandart<\/em>&nbsp;is a floating classroom and cultural bridge:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\" translation-block\">Formation des jeunes marins : en dehors des festivals, le navire sert de voilier-\u00e9cole, pr\u00e9parant la jeunesse au secteur maritime europ\u00e9en.<\/li>\n\n\n\n<li class=\" translation-block\">\u00c9quipage international : chaque voyage r\u00e9unit des personnes de nationalit\u00e9s diff\u00e9rentes dans un esprit de coop\u00e9ration et de respect mutuel.<\/li>\n\n\n\n<li class=\" translation-block\">Valeur culturelle : rare r\u00e9plique \u00e0 l\u2019\u00e9chelle r\u00e9elle d\u2019une fr\u00e9gate du XVIII\u1d49 si\u00e8cle, le Shtandart enrichit les festivals maritimes et attire des milliers de visiteurs.<\/li>\n\n\n\n<li class=\" translation-block\">Soutien du public : plus de 8 000 personnes ont sign\u00e9 une p\u00e9tition en d\u00e9fense du navire, et des organisations comme MOR GLAZ continuent de soutenir sa pr\u00e9sence dans les ports fran\u00e7ais.<\/li>\n<\/ul>\n\n\n\n<p class=\" translation-block\">En plus de vingt ans d\u2019escales, le Shtandart n\u2019a jamais provoqu\u00e9 de troubles, seulement admiration et inspiration.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Appel aux autorit\u00e9s maritimes et au public europ\u00e9en<\/h2>\n\n\n\n<p>L\u2019interdiction actuelle n\u2019est soutenue ni par la loi, ni par les principes de coop\u00e9ration europ\u00e9enne, de protection du patrimoine culturel ou de libert\u00e9 de circulation. Elle est le produit d\u2019une mauvaise application r\u00e9glementaire et d\u2019une campagne agressive de diffamation men\u00e9e par un groupe d\u2019activistes.<\/p>\n\n\n\n<p>Nous appelons les autorit\u00e9s maritimes europ\u00e9ennes \u00e0 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\" translation-block\">Reconna\u00eetre le Shtandart comme navire europ\u00e9en de valeur culturelle et \u00e9ducative.<\/li>\n\n\n\n<li>Lui permettre de continuer \u00e0 participer aux festivals maritimes et aux escales portuaires.<\/li>\n\n\n\n<li>Soutenir les d\u00e9marches visant \u00e0 obtenir une interpr\u00e9tation juridique confirmant qu\u2019il n\u2019est pas concern\u00e9 par les sanctions.<\/li>\n<\/ul>\n\n\n\n<p class=\" translation-block\">Le Shtandart n\u2019incarne pas la division, mais la paix, l\u2019unit\u00e9 et le patrimoine.
